Terms And Conditions For The Provision Of Electronic Services

§ 1 GENERAL PROVISIONS

  1. Pursuant to Art. 8 sec. 1 point 1 of the Act of 18 July 2002 on the provision of electronic services (Official Gazette of 2020, item 344, as amended), Room23 Tours limited liability company (trading as Poland At War Tours) with its registered office in Warsaw establishes these regulations for the provision of services electronically (hereinafter referred to as the “Regulations“) and undertakes to comply with them.
  2. The Regulations define the conditions for the provision of electronic services by Room23 Tours sp. z o. o. based in Warsaw via the www.polandatwartours.com  website (hereinafter referred to as the “Website“).
  3. The Regulations define the rights and obligations of Users related to their use of the Website.
  4. The provisions of the Regulations together with the provisions of the law in force in the territory of the Republic of Poland define the rights and obligations of the User related to the use of the Website, as well as the rights, obligations and liabilities of the Administrator and other entities that provide Users with their services or products through the Website.
  5. The User using the Website is obliged to read the content of the Regulations and accept the rules contained therein. Making a reservation through the Website is possible only after the User confirms that they have read the Regulations and accept its terms.
  6. The Website administrator is Room23 Tours (trading at Poland At War Tours), a limited liability company with its registered office in Warsaw, address: ul. Chmielna 73B, office 14, 00-801 Warsaw, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Division of the National Court Register under the KRS number: 0000897799, NIP: 5272957022, REGON: 388906688, with the share capital of PLN 5,000.00 paid in full, entered by the Marshal of the Mazowieckie Voivodeship in the Register of Tour Operators and Entrepreneurs Facilitating Linked Travel Arrangements at evidence number 29671 (hereinafter referred to as the “Administrator“).
  7. The Administrator makes the Regulations available to the User free of charge, before concluding the Contract, and in such a way that enables the User to obtain, reproduce and record the contents of the Regulations through the Website.
  8. The User is not bound by the provisions of the Regulations that have not been made available to them in the manner described in § 1 sec. 7 of the Regulations.
  9. The provision of the Service begins after the conclusion of the Contract in accordance with the rules set out in the GTC in force at the time of the conclusion of the Contract.

§ 2 DEFINITIONS

The terms used in the Regulations should be understood as follows:

Administrator – an entity specified in § 1 sec. 6 of the Regulations, being the owner and administrator of the Website.

Consumer – a User who is a natural person who performs a legal transaction with the Administrator not related directly to his business or professional activity.

Contract – the term has the meaning given to it by the GTC.

Cookies – small text files saved and stored on the User’s devices through which the User uses the pages of the Website.

GTC – General Terms and Conditions for the Provision of Services by Room23 Tours sp. z o. o. (trading as Poland At War Tours) of October 1, 2021.

Information Clause – Information clause of Room23 Tours sp. z o. o. available at www.polandatwartours.com.

Regulations – these regulations for the provision of electronic services by Room23 Tours sp. z o. o., specifying the terms of using the Website and the provision of services by the Administrator.

Sales Point – the term has the meaning given to it by the GTC.

Services – the term has the meaning given to it by the GTC.

Services provided electronically – performance of a service provided without the simultaneous presence of the parties (at a distance), through the transmission of data at the individual request of the service recipient, sent and received using electronic processing devices, including digital compression, and data storage, which is fully broadcast, received or transmitted through a telecommunications network within the meaning of the Act of 16 July 2004 Telecommunications Law (Official Gazette of 2021, item 576, as amended).

Special event – the term has the meaning given to it by the GTC.

Standard event – the term has the meaning given to it by the GTC.

Ticket – has the meaning given to it by the GTC.

Tourist Event – a combination of at least two different types of travel services for the same trip or vacation, meeting the conditions referred to in art. 5 sec. 1 of the Act of 24 November 2017 on tourist events and related tourist services (Official Gazette of 2020, item 2139, as amended).

Tour leader – the term has the meaning given to him by the GTC.

User – any natural person using the Website, regardless of whether they act on their own behalf or on behalf of and for the benefit of third parties.

Website – website, including the website available at www.polandatwartours.com with all materials, plants and subpages owned by the Administrator. 

§ 3 RULES OF USING THE WEBSITE

  1. The information, materials and prices presented on the Website do not constitute an offer within the meaning of the provisions of the Act of 23 April 1964 of the Civil Code (Official Gazette of 2020, item 1740, as amended), and constitute only an invitation to submit offers. The final price of the Service is calculated when booking.
  2. Using the Website requires the User to read, understand, accept and comply with the Regulations.
  3. the Website requires:
  1. having a device with access to the Internet;
  2. connection to the Internet;
  3. having an active e-mail account;
  4. having an installed web browser that supports SSL and javascript encrypted connections, in particular:
  1. Internet Explorer 11.0.40 or higher,
  2. Microsoft Edge 3 version 16 or higher,
  3. Mozilla Firefox version 59 or higher,
  4. Safari 11 or higher,
  5. Google Chrome 5 version 64 or higher.
  1. The Administrator ensures the functioning of the Website in a way that enables the User to terminate the use of electronic services provided by the Administrator through the Website free of charge.
  2. The Administrator ensures unambiguous identification of the parties to electronic services.
  3. The Administrator informs that the use of Services provided electronically is associated with risk. In order to minimize the risk referred to above, the User is obliged to take appropriate actions necessary to secure the device used by them to use the Administrator’s Website.

§ 4 TYPES AND SCOPE OF ELECTRONIC SERVICES

  1. The Website is available 24 hours a day at www.polandatwartours.com.
  2. The Administrator on the Website allows Users, among others to:
  1. get acquainted with the types of Services provided;
  2. get acquainted with the current information on Standard Events, as well as the rules for the organization of Special Events;
  3. get acquainted with information about currently conducted promotional campaigns;
  4. get acquainted with the GTC and information on the processing of personal data;
  5. declare the willingness to receive information about current promotions and other information, including commercial information by e-mail;
  6. book the Service;
  7. purchase of seats in a Tourist Event constituting the subject of the Service, as well as payment for them;
  8. obtain general information on participation in a Tourist Event, including, inter alia, necessary information on:
  1. the duration of the Tourist Event;
  2. type and category of the hotel facility;
  3. the price of the Tourist Event along with the payment date;
  4. place of stay.
  1. The Administrator reserves that in the event of promotional campaigns, it may happen at any time that the proposal displayed to the User has just been sold to another recipient. The User is not entitled to any compensation in this respect.
  2. In order to receive the information referred to in § 4 sec. 2 e) of the Regulations, the User must consent by sending a message to the address contact@polandatwartours.com. Subscription information will be sent only after confirmation of the User’s will to receive it. The user may at any time unsubscribe from receiving information under the subscription by clicking the appropriate link in the body of the e-mail message.
  3. The Administrator informs on the Website about the category of hotels offered using graphic symbols in the form of stars. The symbols denote the category of the accommodation facility according to the regulations of the country of residence referred to in Art. 40 sec. 1 point 1 c) of the Act of 24 November 2017 on package travel and linked travel arrangements (Official Gazette of 2020, item 2139 as amended).
  4. The provisions of the GTC, the content of which is available on the Website and at the Sales Point, apply to booking and concluding the Contract, as well as to withdraw from the Contract, change the booking or the terms of the Contract, and to the complaint procedure. The currently valid version of the GTC is also sent to the User as an attachment to the e-mail containing the confirmation of the conclusion of the Contract.

§ 5 CONDITIONS FOR BOOKING

  1. The Service reservation made by the User is treated as a proposal to conclude a Contract with the Administrator.
  2. A reservation may be made:
  1. through the Website;
  2. by sending an e-mail to contact@polandatwartours.com;
  3. in person at the Sales Point.
  1. Correct submission of a reservation requires the User to provide the following personal data of the person making the reservation and, if necessary for the provision of the Services, personal data of persons for whom the Service is to be provided: name, surname, address, telephone number, e-mail address, copy of a passport and place accommodation during the stay in Poland, as long as the accommodation is not the subject of the Service.
  2. The confirmation of the conclusion of the Contract and payment of the price for the Service (which together shall be considered equivalent to the conclusion of the Contract) is:
  1. in case of booking in the Sales Point – the Ticket issued to the User by the Sales Point, in which the User paid for the Service;
  2. in case of booking through the Website – an electronic proof of reservation sent to the User by the Administrator via e-mail, after the User has made the reservation.
  1. The User is obliged to immediately check whether the information on the Ticket or the booking confirmation is correct. 
  2. The condition for concluding the Contract is the payment of the full price for the Service, unless the description of the Service available in the Sales Point or on the Website indicates the possibility of paying part of the price at a later time or if individually agreed otherwise, but not later than on the date of beginning of the Service, by making a payment directly to the Administrator. 
  3. A Contract under which payment of part or all of the price is allowed no later than on the date of commencement of the Service, may be terminated by the Administrator due to the User’s fault, in the event of non-payment.
  4. In case of Services the subject of which is realization of a Tourist Event, the User may request a copy of the Contract in paper form, if it was concluded in the simultaneous physical presence of the parties. 
  5. The User booking the Service is responsible for paying the full price of the Service for themself and for all tourists reported as participants in the reservation.
  6. The User who does not have a proof of identity matching the Ticket or a proof of booking, which would confirm that they are entitled to use the Service, will not be able to become a beneficiary of the Service. The name and surname on the ID card or the passport are the most important elements of the User’s identification. 
  7. The type and scope of services provided for in the Service is determined on the basis of the information provided on the Website and at the Point of Sale, valid at the time of booking. Before concluding the Contract, the Administrator reserves the right to change the data contained in the above-mentioned places at any time, about which the Administrator will inform the User who is booking the Service in accordance with art. 40 sec. 3 of 24 November 2017 on tourist events and related tourist services (Journal of Laws of 2020, item 2139).
  8. In the event of a contradiction in information relating to a given Service placed on the Website and in the Sales Point, the information placed on the Website shall prevail.
  9. The minimum number of participants of a given Service is 10 people, unless the description of the Service placed on the Website or available at the Sales Point provides otherwise.
  10. The User receives contact details of the Tour Leader upon concluding the Contract.
  11. If the parties have agreed to meet the User’s special requirements, the scope of these requirements will be indicated in the booking confirmation.
  12. The Administrator reserves the right to refuse to provide Services to Users who:
  1. flagrantly violated or, particularly violate the good name of victims of Nazism, in particular victims of the Holocaust; 
  2. behave or speak publicly in a manner negating Nazi crimes or the Holocaust;
  3. defaming the places devoted to memory of victims of the Holocaust or places of worship;
  4. encouraging hatred of any kind, in particular hate speech;
  5. carry out manifestations of offensive, provocative or political nature;
  6. present symbols and signs promoting Nazism or other totalitarian systems.
  7. Refusal to provide Services for reasons specified in § 5 sec. 16 does not constitute an unjustified refusal to provide services.

§ 6 LIABILITY

  1. The Administrator reserves that the use of the Website by the User takes place solely at the expense and risk of the User. The Administrator does not give any guarantees that the use of the Website by the User will run without faults, breaks or defects, in particular the Administrator is not responsible for:
  1. independent, technically incorrect operation of the Website and for interruptions in the availability of the Website for reasons attributable to third parties or due to force majeure;
  2. the effects of events that occurred while browsing the Website, resulting from the User’s fault or the behaviour of third parties or force majeure.
  3. Users’ behaviour on the Website, and is not responsible for the consequences of actions taken by Users and third parties, and constituting a breach of the provisions of the Regulations;
  4. deficiencies and errors in the content posted on the Website.
  1. The Administrator is not responsible for any malfunction of the devices, the Internet, the operating system or the User’s browser, including in particular any applications, extensions, additional functionalities, add-ons and software installed in the User’s operating system or browser.
  2. The Administrator informs that pursuant to art. 8 sec. 3 point 2 b of the Act of 18 July 2002 on the provision of electronic services, Users are prohibited from introducing illegal content to the Website.
  3. The Administrator reserves the right to change the content of the Website at any time, in particular to: add, change and delete the available content and pages. The Administrator does not bear any responsibility for the events arising while browsing the Website’s subpages.

§ 7 COMPLAINTS

  1. The provisions of this paragraph shall apply, provided that the Regulations, GTC or other applicable policies or regulations issued by the Administrator do not provide for detailed procedures for submitting and considering complaints.
  2. The provisions of the Regulations do not apply to the complaint procedure regarding the Services provided by the Administrator, which are regulated by the GTC.
  3. The User may submit a complaint if the services offered on the Website are not performed by the Administrator or are not performed in accordance with the provisions of the Regulations.
  4. Complaints regarding the manner and quality of the Website’s operation, can be reported to the Administrator in the following way: in writing to the following address ul. Chmielna 73B / 14, 00-801 Warsaw or by e-mail to the following address: contact@polandatwartours.com.
  5. A correctly submitted complaint should contain at least: the data of the User submitting the complaint (name, surname, address, contact address) and should indicate the defects and irregularities in the operation of the Website. The complaint should contain a legible and handwritten signature of an authorized person.
  6. The subject of the complaint and its validity are assessed by an employee or an authorized representative of the Administrator within 14 days from the date of receipt of the complaint.
  7. A complaint may be considered unjustified if the irregularities in the operation of the Website occurred through no fault of the Administrator.
  8. If the complaint is found to be justified, after conducting an internal investigation procedure, the Administrator will establish remedial measures aimed at bringing the functioning of the Website to the state of compliance with the Regulations.

§ 8 COPYRIGHT AND LEGAL NOTICE

  1. The Administrator is the owner of the Website and has the exclusive right to introduce changes, add and delete content, as well as modify the rules of its functioning. The Website and its content posted therein are works protected by copyright and are protected by law.
  2. The Website User has the right to obtain the Regulations, its reproduction, copying and saving its content on durable media, with the exception of using it for commercial purposes, in any way without the Administrator’s written consent.
  3. The Administrator prohibits obtaining data from the Website for commercial purposes in any way, in particular using automated systems or software for data acquisition (so-called “screen scraping”), as well as sharing or servicing links to the Website without obtaining the prior written consent of its owner.
  4. All information, data and materials made available on the Website are protected by law.
  5. The Administrator reserves the right to take all necessary measures to protect its rights in the event of unauthorized use of the Website, including legal action, without prior notice to the User.

§ 9 PERSONAL DATA PROTECTION

  1. Personal data provided by the User to the Administrator in connection with their use of the Website is collected and processed by the Administrator in accordance with the applicable law, Information Clause and Cookies policy indicated in § 10 of the Regulations. 
  2. The Administrator may transfer the Users data in their possession to the courts, prosecutor’s office, police and other authorized bodies for the purposes of proceedings conducted by them in connection with the violation of the law by the User, in accordance with applicable law.

§ 10 COOKIES POLICY

  1. The Administrator uses Cookies to enable using the Website.
  2. The Administrator informs about the use of Cookies, which are used to collect information on the use of the Website by Users, in accordance with the regulation contained in art. 173 – 174 of the Act of 16 July 2004 Telecommunications Law (Official Gazette of 2021, item 576).
  3. The purpose of using Cookies is:
  1. adjusting the content of the Website to the User’s preferences and optimizing the use of the Website; in particular, adjusting the manner of displaying the Website to the individual needs of the User related to the type of device used to display the Website;
  2. detection of fraud in the field of authentication on the Website;
  3. adjusting the content of the newsletter to the User’s preferences;
  4. marketing, including remarketing, i.e. displaying advertisements to the User about the Website and the Administrator on other websites;
  5. for statistical purposes, in particular to enable the Administrator to analyse the manner in which Users use the Website;
  6. creating analyses, reports and statistics on the use of the Website pages by Users;
  7. the presentation of advertisements, taking into account the Users’ preferences.
  1. The Cookies technology allows to collect anonymous statistical data about Users. Information obtained thanks to cookie files is not assigned to a specific person and does not allow for its identification.
  2. After visiting the Website, Cookies are sent to the User’s end device to enable the identification of the User’s web browser. Information sent by the User’s browser is automatically registered by the Website.
  3. The Administrator reserves the right to:
  1. sharing data related to Cookies with external entities, including entities processing data on behalf of the Administrator, in particular technical service providers;
  2. posting and using Cookies by advertisers cooperating with the Administrator.
  1. The Website may contain links to third-party services, including: social network plugins, maps and applications. The use of these links by the User will redirect the User to the websites of the indicated external entities, which may result in sending their information to the indicated entities.
  2. The User may at any time change the cookie settings in their web browser or disable the use of Cookies. The Administrator reserves, however, that this may cause the Website to function improperly or unable to use the Website.
  3. Failure to change the default settings of the web browser used by the User in the field of Cookies will result in placing Cookies on the end device used by the User and using them in accordance with the rules specified by the provider of the web browser.
  4. Information on managing Cookies in individual types of browsers can be found on pages dedicated to those browsers.
  5. Users who, after reading the information available on the Website, do not want Cookies to remain in the device’s web browser, should delete them from their browser after completing their visit to the Website.

§ 11 FINAL PROVISIONS

  1. In matters not covered by the Regulations, the generally applicable provisions of Polish law shall apply, in particular:
  1. the Act of July 18, 2002 on the provision of electronic services (Official Gazette of 2020, item 344, as amended);
  2. the Act of 23 April 1964 Civil Code (Official Gazette of 2020, item 1740, as amended);
  3. the Act of 24 November 2017 on package travel and linked travel arrangements (Official Gazette of 2020, item 2139);
  4. the Act of 30 May 2014 on consumer rights (Official Gazette of 2020, item 287, as amended);
  5. the Act of February 4, 1994 on copyright and related rights (Official Gazette of 2006, item 90, item 631, as amended).
  1. All disputes related to the provision of Services by the Administrator are settled by the materially and territorially competent Polish courts.
  2. Amendments to the Regulations will be made by posting the new content of the Regulations on the Website. The amended Regulations come into force upon their publication on the Website. Information about the changes will be published on the Website on an ongoing basis.
  3. The provisions of the Regulations do not affect generally applicable law.
  4. If any provision of the Regulations is deemed invalid by a valid court decision, the remaining provisions shall remain in force.
  5. The Regulations has been made in Polish and English language version. In case of any discrepancies the Polish language version shall prevail.
  6. The methods of out-of-court resolution of consumer disputes are specified in the Act of 23 September 2016 on out-of-court resolution of consumer disputes (Official Gazette of 2016, item 1823). The entities authorized to conduct cases in the field of tourist services are municipal and poviat consumer ombudsmen and Trade Inspections.   7. The Administrator does not participate in the voluntary procedure of alternative dispute resolution conducted by the European Commission. Therefore, the User may not use the ODR platform http://ec.europa.eu/consumers/odr European Commission.

REGULAMIN ŚWIADCZENIA USŁUG DROGĄ ELEKTRONICZNĄ 

PRZEZ ROOM23 TOURS SP. Z O.O. 

§ 1 POSTANOWIENIA OGÓLNE

  1. Na podstawie art. 8 ust. 1 pkt 1 ustawy z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną (Dz.U. z 2020 r. poz. 344 z późn. zm.), Room23 Tours spółka z ograniczoną odpowiedzialnością (prowadząca działalność pod nazwą Poland At War Tours) z siedzibą w Warszawie ustala niniejszy regulamin świadczenia usług drogą elektroniczną (nazywany w dalszej części „Regulaminem”) i zobowiązuje się do jego przestrzegania. 
  2. Regulamin określa warunki świadczenia usług drogą elektroniczną przez Room23 Tours sp. z o. o. z siedzibą w Warszawie za pośrednictwem strony internetowej www.polandatwartours.com, (nazywanej w dalszej części Regulaminu „Serwisem”). 
  3. Regulamin określa prawa i obowiązki Użytkowników związane z korzystaniem przez nich z Serwisu. 
  4. Postanowienia Regulaminu wraz z przepisami prawa obowiązującego na terenie Rzeczypospolitej Polskiej określają prawa i obowiązki Użytkownika, związane z korzystaniem z Serwisu, a także prawa, obowiązki i zobowiązania Administratora oraz innych podmiotów, które za pomocą Serwisu udostępniają Użytkownikom swoje usługi lub produkty.
  5. Użytkownik korzystający z Serwisu jest zobowiązany do zapoznania się z treścią Regulaminu oraz zaakceptowania zawartych w nim zasad. Dokonanie rezerwacji za pośrednictwem Serwisu jest możliwe wyłącznie po potwierdzeniu Użytkownika zapoznania się z Regulaminem i zaakceptowaniu jego warunków. 
  6. Administratorem Serwisu jest spółka Room23 Tours spółka z ograniczoną odpowiedzialnością (prowadząca działalność pod nazwą Poland At War Tours) z siedzibą w Warszawie, adres: ul. Chmielna 73B, lok. 14, 00-801 Warszawa, wpisana do Rejestru Przedsiębiorców Krajowego Rejestru Sądowego prowadzonego przez Sąd Rejonowy dla m.st. Warszawy w Warszawie XIII Wydział Gospodarczy Krajowego Rejestru Sądowego pod numerem KRS: 0000897799, NIP: 5272957022, REGON: 388906688, posiadającej kapitał zakładowy w wysokości 5.000,00 zł wpłacony w całości, wpisana przez Marszałka Województwa Mazowieckiego do Centralnej Ewidencji Organizatorów Turystyki i Przedsiębiorców Ułatwiających Nabywanie Powiązanych Usług Turystycznych pod nr ewidencyjnym 29671 (w dalszej części Regulaminu nazywana „Administratorem”). 
  7. Administrator nieodpłatnie udostępnia Regulamin Użytkownikowi, przed zawarciem Kontraktu, a także w taki sposób, który umożliwia Użytkownikowi pozyskanie, odtwarzanie i utrwalanie treści Regulaminu za pomocą Serwisu. 
  8. Użytkownik nie jest związany postanowieniami Regulaminu, które nie zostały mu udostępnione w sposób opisany w § 1 ust. 7 Regulaminu.
  9. Rozpoczęcie świadczenia Usługi następuje po zawarciu Kontraktu zgodnie z zasadami określonymi w OWU obowiązujących w chwili zawarcia Kontraktu.

§ 2 DEFINICJE

Pojęcia użyte w Regulaminie należy rozumieć w następujący sposób:

Administrator – podmiot wskazany w § 1 ust. 6 Regulaminu, będący właścicielem oraz administratorem Serwisu.

Konsument – Użytkownik będący osobą fizyczną, który dokonuje z Administratorem czynności prawnej niezwiązanej bezpośrednio z jego działalnością gospodarczą lub zawodową.

Kontrakt – pojęcie ma znaczenie nadane mu przez OWU.

Cookies – zapisywane i przechowywane na urządzeniach Użytkownika niewielkie pliki tekstowe, za pośrednictwem których Użytkownik korzysta ze stron internetowych Serwisu.

OWU – Ogólne Warunki Realizacji Usług przez spółkę Room23 Tours sp. z o.o. (prowadzącą działalność pod nazwą Poland At War Tours)  z dnia www.polandatwartours.com.

Klauzula Informacyjna – Klauzula Informacyjna Room23 Tours sp. z o.o. dostępna pod adresem www.polandatwartours.com.

Regulamin – niniejszy regulamin świadczenia usług drogą elektroniczną przez Room23 Tours sp. z o.o., określający warunki korzystania z Serwisu i świadczenia usług przez Administratora.

Punkt Sprzedaży – pojęcie ma znaczenie nadane mu przez OWU.

Usługi – pojęcie ma znaczenie nadane mu przez OWU.

Usługi świadczone drogą elektroniczną – wykonanie usługi świadczonej bez jednoczesnej obecności stron (na odległość), poprzez przekaz danych na indywidualne żądanie usługobiorcy, przesyłanej i otrzymywanej za pomocą urządzeń do elektronicznego przetwarzania, włącznie z kompresją cyfrową, i przechowywania danych, która jest w całości nadawana, odbierana lub transmitowana za pomocą sieci telekomunikacyjnej w rozumieniu ustawy z dnia 16 lipca 2004 r. prawo telekomunikacyjne ((Dz.U. z 2021 r. poz. 576 ze zmianami).

Wydarzenie standardowe – pojęcie ma znaczenie nadane mu przez OWU. 

Wydarzenie specjalne – pojęcie ma znaczenie nadane mu przez OWU.

Bilet – ma znaczenie nadane mu przez OWU.

Impreza Turystyczna – połączenie co najmniej dwóch różnych rodzajów usług turystycznych na potrzeby tej samej podróży lub wakacji, spełniające warunki, o których mowa w art. 5 ust. 1 ustawy z dnia z dnia 24 listopada 2017 r. o imprezach turystycznych i powiązanych usługach turystycznych (Dz.U. z 2020 r. poz. 2139).

Lider Wycieczki – pojęcie ma znaczenie nadane mu przez OWU.

Użytkownik – każda osoba fizyczna korzystająca z Serwisu, bez względu na to czy działa we własnym imieniu czy w imieniu i na rzecz osób trzecich.

Serwis – serwis internetowy, obejmujący stronę internetową dostępną pod adresem www.polandatwartours.com wraz ze wszystkimi materiałami, zakładami oraz podstronami, stanowiącymi własność Administratora. 

§ 3 ZASADY KORZYSTANIA Z SERWISU

  1. Prezentowane w Serwisie informacje, materiały oraz ceny nie stanowią oferty w rozumieniu przepisów ustawy z dnia 23 kwietnia 1964 r. kodeks cywilny (Dz.U. z 2020 r. poz. 1740 ze zmianami), a stanowią wyłącznie zaproszenie do składania ofert. Obliczenie końcowej ceny Usługi następuje podczas dokonywania rezerwacji.
  2. Korzystanie z Serwisu wymaga od Użytkownika zapoznania się ze zrozumieniem, zaakceptowania i przestrzegania treści Regulaminu. 
  3. Do prawidłowego działania Serwisu, niezbędne jest: 
  1. posiadanie urządzenia z dostępem do sieci Internet;  
  2. połączenie z siecią Internet;
  3. posiadanie aktywnego konta poczty elektronicznej;
  4. posiadanie zainstalowanej przeglądarki internetowej obsługującej połączenia szyfrowane SSL i javascript, w szczególności: 
  1. Internet Explorer 11.0.40 lub wyższej, 
  2. Microsoft Edge 3 w wersji 16 lub wyższej, 
  3. Mozilla Firefox w wersji 59 lub wyższej, 
  4. Safari w wersji 11 lub wyższej, 
  5. Google Chrome 5 w wersji 64 lub wyższej.
  1. Administrator zapewnia funkcjonowanie Serwisu w sposób umożliwiający Użytkownikowi w każdej chwili nieodpłatne zakończenie korzystania z usług elektronicznych świadczonych przez Administratora za pośrednictwem Serwisu. 
  2. Administrator zapewnia jednoznaczną identyfikację stron usług elektronicznych.
  3. Administrator informuje, że korzystanie z Usług świadczonych drogą elektroniczną wiąże się z ryzykiem. W celu minimalizowania ryzyka, o którym mowa powyżej Użytkownik zobowiązany jest podjąć stosowne działania niezbędne do zabezpieczenia urządzenia, na którym korzysta z Serwisu Administratora.

§ 4 RODZAJE I ZAKRES USŁUG ŚWIADCZONYCH DROGĄ ELEKTRONICZNĄ

  1. Serwis jest dostępny całodobowo pod adresem www.polandatwartours.com. 
  2. Administrator w ramach Serwisu umożliwia Użytkownikom m.in.:  
  1. zapoznanie się z rodzajami świadczonych Usług; 
  2. zapoznanie się z aktualnymi informacjami na temat Wydarzeń standardowych, a także zasadach organizacji Wydarzeń specjalnych; 
  3. zapoznanie się z informacjami o aktualnie prowadzonych akcjach promocyjnych;
  4. zapoznanie się z OWU oraz informacjami w zakresie przetwarzania danych osobowych;
  5. zgłoszenie chęci otrzymywania informacji o aktualnych promocjach oraz innych informacji, w tym informacji handlowych za pomocą wiadomości email; 
  6. dokonanie rezerwacji Usługi; 
  7. nabycie miejsc w Imprezie Turystycznej stanowiącej przedmiot Usługi, jak również dokonanie za nie płatności;
  8. uzyskanie ogólnych informacji dotyczących udziału w Imprezie Turystycznej, w tym m.in. niezbędnych informacji na temat:
  1. czasu trwania Imprezy Turystycznej;
  2. rodzaju, kategorii obiektu hotelarskiego;
  3. ceny Imprezy Turystycznej wraz z terminem zapłaty;
  4. miejsca pobytu.
  1. Administrator zastrzega, że w przypadku występowania akcji promocyjnych w każdej chwili może się zdarzyć, że propozycja wyświetlona Użytkownikowi została właśnie sprzedana innemu odbiorcy. Z tego tytułu Użytkownikowi nie przysługuje żadne roszczenie odszkodowawcze.
  2. W celu otrzymywania informacji, o których mowa w § 4 ust. 2 lit. e) Regulaminu, Użytkownik musi wyrazić zgodę przez wysłanie wiadomości na adres contact@polandatwartours.com. Informacje w ramach subskrypcji będą wysyłane dopiero po potwierdzeniu woli ich otrzymywania przez Użytkownika.
    Użytkownik może w każdym momencie zrezygnować z otrzymywania informacji w ramach subskrypcji, przez kliknięcie odpowiedniego odnośnika w treści wiadomości e-mail. 
  3. Administrator informuje w Serwisie o kategorii oferowanych hoteli przy użyciu symboli graficznych w postaci gwiazdek. Symbole oznaczają kategorię obiektu zakwaterowania według przepisów kraju pobytu, o której mowa w art. 40 ust. 1 pkt 1 lit. c) ustawy z dnia 24 listopada 2017 r. o imprezach turystycznych i powiązanych usługach turystycznych (Dz.U. z 2020 r. poz. 2139). 
  4. Do dokonania rezerwacji i zawarcia Kontraktu, a także do odstąpienia od Kontraktu, zmiany rezerwacji lub warunków Kontraktu oraz do postępowania reklamacyjnego znajdują zastosowanie postanowienia OWU, którego treść jest dostępna w Serwisie, a także w Punkcie Sprzedaży. Aktualnie obowiązująca wersja OWU jest również wysyłana Użytkownikowi jako załącznik do wiadomości e-mail zawierającej potwierdzenie zawarcia Kontraktu.

§ 5 WARUNKI DOKONYWANIA REZERWACJI 

  1. Dokonana przez Użytkownika rezerwacja Usługi traktowana jest jako propozycja zawarcia Kontraktu z Administratorem. 
  2. Rezerwacja może zostać złożona: 
  1. za pomocą Serwisu;
  2. przez wysłanie wiadomości e-mail na adres contact@polandatwartours.com; 
  3. osobiście w Punkcie Sprzedaży. 
  1. Poprawne złożenie rezerwacji wymaga podania przez Użytkownika następujących danych osobowych osoby dokonującej rezerwację oraz, jeśli jest to konieczne do realizacji Usług, danych osobowych osób, na rzecz których Usługa ma być realizowana: imię, nazwisko, adres, numer telefonu, adres e-mail, kopię paszportu i miejsce zakwaterowania podczas pobytu w Polsce, o ile przedmiotem Usługi jest również zakwaterowanie. 
  2. Potwierdzeniem rezerwacji oraz potwierdzeniem uiszczenia ceny za Usługę (co jest łącznie równoznaczne z zawarciem Kontraktu) jest: 
  1. w przypadku rezerwacji w Punkcie Sprzedaży – Bilet wystawiony Użytkownikowi przez Punkt Sprzedaży, w którym Użytkownik zapłacił za Usługę; 
  2. w przypadku rezerwacji za pośrednictwem Serwisu – elektroniczny dowód rezerwacji wysłany do Użytkownika przez Administratora za pomocą poczty elektronicznej, po dokonaniu rezerwacji przez Użytkownika. 
  1. Użytkownik jest zobowiązany do niezwłocznego zweryfikowania prawidłowości danych zawartych na Bilecie lub dowodzie rezerwacji. 
  2. Warunkiem zawarcia Kontraktu jest zapłata pełnej ceny za Usługę, chyba że opis Usługi dostępny w Punkcie Sprzedaży lub w Serwisie wskazuje na możliwość zapłaty części ceny w czasie późniejszym lub gdy indywidualnie uzgodniono inaczej, jednakże nie później niż w dacie rozpoczęcia Usługi przez dokonanie wpłaty bezpośrednio Administratorowi.
  3. Kontrakt, zgodnie z którym płatność części lub całości ceny jest dopuszczalna nie później niż w dacie rozpoczęcia Usługi, może zostać rozwiązany przez Administratora z winy Użytkownika, w przypadku braku płatności. 
  4. W przypadku Usług, których przedmiotem jest realizacja Imprezy Turystycznej, Użytkownik może żądać kopii Kontraktu w wersji papierowej, jeżeli został on zawarty w jednoczesnej obecności stron. 
  5. Użytkownik rezerwujący Usługę jest odpowiedzialny za zapłatę pełnej ceny Usługi za siebie oraz za wszystkich turystów zgłaszanych jako uczestnicy w rezerwacji. 
  6. Użytkownik, który nie posiada dowodu tożsamości zgodnego z Biletem lub dowodu rezerwacji, który potwierdziłby, że ma on prawo do korzystania z Usługi, nie będzie mógł zostać beneficjentem Usługi. Imię i nazwisko znajdujące się w dowodzie tożsamości lub w paszporcie są najistotniejszymi elementami identyfikacji Użytkownika. 
  7. Rodzaj i zakres świadczeń przewidzianych w ramach Usługi jest określany na podstawie informacji zamieszczonych w Serwisie oraz w Punkcie Sprzedaży aktualnych na chwilę składania rezerwacji. Przed zawarciem Kontraktu Administrator zastrzega sobie prawo do zmiany w każdym czasie danych zawartych wymienionych powyżej miejscach, o czym Administrator poinformuje Użytkownika rezerwującego Usługę zgodnie z art. 40 ust. 3 z dnia 24 listopada 2017 r. o imprezach turystycznych i powiązanych usługach turystycznych (Dz.U. z 2020 r. poz. 2139).
  8. W razie sprzeczności informacji odnoszących się do Usługi umieszczonych w Serwisie oraz dostępnych w Punkcie Sprzedaży, pierwszeństwo mają informacje umieszczone w Serwisie. 
  9. Minimalna liczba uczestników danej Usługi wynosi 10 osób, chyba, że opis Usługi umieszczony w Serwisie lub dostępny w Punkcie Sprzedaży stanowi inaczej. 
  10. Użytkownik otrzymuje dane kontaktowe do Lidera Wycieczki wraz z zawarciem Kontraktu. 
  11. O ile strony uzgodniły spełnienie specjalnych wymagań Użytkownika, zakres tych wymagań zostanie wskazany w potwierdzeniu rezerwacji. 
  12. Administrator zastrzega sobie prawo do odmowy świadczenia Usług Użytkownikom, którzy: 
  1. w sposób rażący naruszyli bądź naruszają dobre imię ofiar nazizmu, w szczególności ofiar Holokaustu;
  2. zachowują się lub publicznie wypowiadają w sposób negujący zbrodnie nazistowskie lub Holokaust;
  3. znieważają miejsca poświęcone pamięci ofiar Holokaustu lub miejsca kultu;
  4. nawołują do nienawiści w jakiejkolwiek formie, w szczególności przez mowę nienawiści;
  5. przeprowadzają manifestacje o charakterze obraźliwym, prowokacyjnym bądź politycznym;
  6. prezentują symbole i znaki propagujące nazizm bądź inne systemy totalitarne.
  7. Odmowa świadczenia Usług z przyczyn wskazanych w § 5 ust. 16 nie stanowi nieuzasadnionej odmowy świadczenia usług. 

§ 6 ODPOWIEDZIALNOŚĆ 

  2. Administrator zastrzega, że korzystanie przez Użytkownika z Serwisu odbywa się wyłącznie na koszt i ryzyko Użytkownika. Administrator nie udziela żadnych gwarancji, że korzystanie przez Użytkownika z Serwisu będzie przebiegało bez usterek, przerw lub wad, w szczególności Administrator nie ponosi odpowiedzialności za:
  1. niezależne od niego, nieprawidłowe pod względem technicznym działanie Serwisu oraz za przerwy w dostępności Serwisu z przyczyn leżących po stronie osób trzecich ani spowodowanych działaniami siły wyższej; 
  2. skutki zdarzeń zaistniałych podczas przeglądania Serwisu, powstałych z winy Użytkownika lub spowodowanych zachowaniem osób trzecich albo zaistnieniem siły wyższej. 
  3. zachowania Użytkowników w ramach Serwisu, jak również nie ponosi odpowiedzialności za następstwa działań podjętych przez Użytkowników oraz osoby trzecie, a stanowiących naruszenie postanowień Regulaminu; 
  4. uchybienia i błędy w treściach zamieszczonych w Serwisie.
  1. Administrator nie odpowiada za nieprawidłowe działanie urządzeń, sieci Internet, systemu operacyjnego lub przeglądarki Użytkownika, w tym w szczególności wszelkich aplikacji, rozszerzeń, dodatkowych funkcjonalności, dodatków i oprogramowania zainstalowanego w systemie operacyjnym lub przeglądarce Użytkownika.
  2. Administrator informuje, że zgodnie z art. 8 ust. 3 pkt 2 lit. b ustawy z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną, Użytkowników obowiązuje zakaz wprowadzania do Serwisu treści o charakterze bezprawnym. 
  3. Administrator zastrzega sobie prawo zmiany zawartości Serwisu w każdej chwili, w szczególności do: dodawania, zmiany i usuwania dostępnych treści oraz stron. Administrator nie ponosi żadnej odpowiedzialności za zdarzenia wynikłe podczas przeglądania podstron Serwisu. 

§ 7 REKLAMACJE

  1. Postanowienia niniejszego paragrafu znajdują zastosowanie, o ile Regulamin, OWU albo inne obowiązujące polityki lub regulaminy wydane przez Administratora nie przewidują szczegółowych procedur zgłaszania i rozpatrywania reklamacji. 
  2. Postanowienia Regulaminu nie mają zastosowania do postępowania reklamacyjnego dotyczącego Usług realizowanych przez Administratora, które regulują OWU.
  3. Użytkownik może złożyć reklamację, jeżeli usługi oferowane w ramach Serwisu nie są realizowane przez Administratora lub są realizowane niezgodnie z postanowieniami Regulaminu. 
  4. Reklamacje dotyczące sposobu i jakości działania Serwisu mogą być zgłaszane Administratorowi w następujący sposób: pisemnie na adres: ul. Chmielna 73B/14, 00-801 Warszawa lub za pośrednictwem e-maila na adres: contact@polandatwartours.com. 
  5. Prawidłowo zgłoszona reklamacja powinna zawierać co najmniej: dane Użytkownika zgłaszającego reklamacje (imię, nazwisko, adres zamieszkania, adres kontaktowy) oraz powinna wskazywać wady i nieprawidłowości w działaniu Serwisu. Reklamacja powinna zawierać czytelny i odręczny podpis uprawnionej osoby.
  6. Oceny przedmiotu reklamacji oraz jej zasadności dokonuje pracownik lub upoważniony przedstawiciel Administratora w terminie 14 dni od dnia otrzymania złożonej reklamacji. 
  7. Reklamacja może zostać uznana za nieuzasadnioną w przypadku gdy nieprawidłowości w działaniu Serwisu wystąpiły nie z winy Administratora.
  8. Jeżeli reklamacja zostanie uznana za uzasadnioną, po przeprowadzeniu wewnętrznego postępowania sprawdzającego, Administrator ustali środki zaradcze, mające na celu doprowadzenie funkcjonowania Serwisu do stanu zgodności z Regulaminem. 

§ 8 PRAWA AUTORSKIE I ZASTRZEŻENIA PRAWNE

  1. Administrator jest właścicielem Serwisu i ma wyłączne prawo do dokonywania w nim zmian, dodawania i usuwania treści, a także modyfikowania zasad jego funkcjonowania. Serwis oraz treści w nim zamieszczane stanowią utwory chronione prawem autorskim i podlegają ochronie prawnej.
  2. Użytkownikowi Serwisu przysługuje prawo do pozyskiwania Regulaminu, jego odtwarzania, kopiowania i utrwalania jego treści na trwałych nośnikach, z wyłączeniem wykorzystania go w celach komercyjnych, w jakikolwiek sposób bez pisemnej zgody Administratora. 
  3. Administrator zabrania pozyskiwania danych z Serwisu do celów komercyjnych w jakikolwiek sposób, w szczególności przy użyciu zautomatyzowanych systemów lub oprogramowania do pozyskiwania danych (tzw. „screen scraping”), a także udostępniania lub obsługiwania łączy do Serwisu bez uzyskania uprzedniej pisemnej zgody jej właściciela.
  4. Wszelkie informacje, dane oraz materiały udostępniane w Serwisie podlegają ochronie prawnej.
  5. Administrator zastrzega prawo do podjęcia wszelkich niezbędnych środków w celu ochrony przysługujących mu praw, w przypadku nieupoważnionego korzystania z Serwisu, włącznie z wystąpieniem na drogę sądową, bez uprzedzania o tym fakcie Użytkownika.

§ 9 OCHRONA DANYCH OSOBOWYCH

  1. Dane osobowe, które Użytkownik przekazuje Administratorowi w związku z korzystaniem przez Użytkownika z Serwisu, Administrator zbiera i przetwarza zgodnie z obowiązującymi przepisami prawa oraz zgodnie z Klauzulą Informacyjną oraz polityką cookies wskazaną w § 10 Regulaminu. 
  2. Administrator może przekazać pozostające w jego posiadaniu dane Użytkowników sądom, prokuraturze, policji i innym uprawnionym organom na potrzeby postępowań prowadzonych przez nich w związku z naruszeniem prawa przez Użytkownika, zgodnie z obowiązującymi przepisami prawa.

§ 10 POLITYKA COOKIES

  1. Administrator wykorzystuje w Serwisie pliki Cookies, które umożliwiają korzystanie ze stron Serwisu.
  2. Administrator, informuje o wykorzystywaniu plików Cookies, które służą do zbierania informacji dotyczących korzystania przez Użytkowników z Serwisu, stosownie do regulacji zawartej w art. 173 – 174 ustawy z dnia z dnia 16 lipca 2004 r. prawo telekomunikacyjne (Dz.U. z 2021 r. poz. 576).
  3. Celem wykorzystywania plików Cookies jest:
  1. dostosowanie zawartości Serwisu do preferencji Użytkownika oraz optymalizacji korzystania z Serwisu; w szczególności dopasowania sposobu wyświetlania Serwisu do indywidualnych potrzeb Użytkownika związanych z rodzajem urządzenia, za pomocą którego korzysta on z Serwisu;
  2. wykrywania nadużyć w zakresie uwierzytelniania w Serwisie;
  3. dostosowania zawartości newslettera do preferencji Użytkownika;
  4. marketingowym, w tym prowadzenia remarketingu, czyli wyświetlania Użytkownikowi reklam dotyczących Serwisu i Administratora na innych stronach internetowych;
  5. dla celów statystycznych, w szczególności umożliwienia Administratorowi przeanalizowania sposobu, w jaki Użytkownicy z korzystają z Serwisu;
  6. tworzenie analiz, raportów i statystyk dotyczących sposobu korzystania ze stron Serwisu przez Użytkowników;
  7. prezentacji reklam z uwzględnieniem preferencji Użytkowników.
  1. Technologia Cookies pozwala na zbieranie anonimowych danych statystycznych o Użytkownikach. Informacje uzyskiwane dzięki plikom Cookie nie są przypisywane do konkretnej osoby i nie pozwalają na jej identyfikację. 
  2. Po odwiedzeniu Serwisu przez Użytkownika do urządzenia końcowego Użytkownika wysyłane są pliki Cookies umożliwiające identyfikację przeglądarki internetowej Użytkownika. Informacje przesyłane przez przeglądarkę Użytkownika są automatycznie rejestrowane przez Serwis.
  3. Administrator zastrzega prawo do: 
  1. udostępniania danych związanych z plikami Cookies podmiotom zewnętrznym, w tym podmiotom przetwarzającym dane w imieniu Administratora, w szczególności dostawcom usług technicznych; 
  2. zamieszczania oraz wykorzystywania plików Cookies przez reklamodawców współpracujących z Administratorem. 
  1. W Serwisie mogą znajdować się odnośniki do usług innych firm, m.in.: wtyczki portali społecznościowych, mapy oraz aplikacje. Korzystanie przez Użytkownika z tych odnośników spowoduje przekierowanie Użytkownika do stron internetowych wskazanych zewnętrznych podmiotów, co może skutkować przesyłaniem jego informacji do wskazanych podmiotów. 
  2. Użytkownik może w dowolnym momencie zmienić ustawienia plików Cookies w swojej przeglądarce internetowej lub wyłączyć obsługę plików Cookies. Administrator zastrzega jednak, że może to spowodować niepoprawne funkcjonowanie Serwisu lub brak możliwości korzystania z Serwisu.
  3. Brak dokonania przez Użytkownika zmiany domyślnych ustawień wykorzystywanej przez niego przeglądarki internetowej w zakresie plików Cookies spowoduje umieszczenie plików Cookies na wykorzystywanym przez Użytkownika urządzeniu końcowym oraz wykorzystywanie ich zgodnie z zasadami określonymi przez dostawcę przeglądarki internetowej.
  4. Informacje na temat zarządzania plikami Cookies w poszczególnych rodzajach przeglądarek można znaleźć na stronach dedykowanych poszczególnym przeglądarkom.
  5. Użytkownicy, którzy po zapoznaniu się z informacjami dostępnymi w Serwisie nie chcą, aby pliki Cookies pozostały zachowane w przeglądarce internetowej urządzenia, powinni usunąć je ze swojej przeglądarki po zakończeniu wizyty w Serwisie.

§ 11 POSTANOWIENIA KOŃCOWE

  1. W sprawach nieuregulowanych Regulaminem mają zastosowanie powszechnie obowiązujące przepisy polskiego prawa, w szczególności: 
  1. ustawy z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną (Dz.U. z 2020 r. poz. 344 z późn. zm.);
  2. ustawy z dnia 23 kwietnia 1964 r. kodeks cywilny (Dz.U. z 2020 r. poz. 1740 ze zmianami);
  3. ustawy z dnia 24 listopada 2017 r. o imprezach turystycznych i powiązanych usługach turystycznych (Dz.U. z 2020 r. poz. 2139);
  4. ustawy z dnia 30 maja 2014 r. o prawach konsumenta (Dz.U. z 2020 r. poz. 287 ze zmianami);
  5. ustawy z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych (t.j. Dz. U. z 2006 r., nr 90, poz. 631 z późn. zm.).
  1. Wszelkie spory związane ze świadczeniem Usług przez Administratora rozstrzygane są przez rzeczowo i miejscowo właściwe polskie sądy powszechne.
  2. Zmiany Regulaminu dokonywane będą przez Administratora Serwisu poprzez zamieszczenie nowej treści Regulaminu na stronie internetowej Serwisu. Zmieniony w ten sposób Regulamin wchodzi w życie z chwilą zamieszczenia go na powyższej stronie. Informacja o dokonaniu zmian będzie na bieżąco publikowana w Serwisie. 
  3. W Postanowienia Regulaminu nie naruszają powszechnie obowiązujących przepisów prawa. 
  4. Jeżeli którekolwiek postanowienie Regulaminu zostanie uznane prawomocnym orzeczeniem sądu za nieważne, pozostałe postanowienia pozostają w mocy. 
  5. Regulamin został sporządzony w polskiej oraz angielskiej wersji językowej. W przypadku jakichkolwiek rozbieżności rozstrzygająca jest polska wersja językowa.
  6. Metody pozasądowego rozwiązywania sporów konsumenckich wskazane są w ustawie z dnia 23 września 2016 r. o pozasądowym rozwiązywaniu sporów konsumenckich (Dz.U. z 2016 r. poz. 1823). Podmiotami uprawnionymi do prowadzenia spraw z zakresu usług turystycznych są miejscy i powiatowi rzecznicy konsumentów oraz Inspekcje Handlowe. Wykaz instytucji znajduje się na stronie Urzędu Ochrony Konkurencji i Konsumentów: https://www.uokik.gov.pl/rejestr_podmiot_uprawnionych.php. 
  7. Administrator nie uczestniczy w dobrowolnej procedurze alternatywnego rozwiązywania sporów prowadzonej przez Komisję Europejską. W związku z tym Użytkownik nie może korzystać z platformy ODR http://ec.europa.eu/consumers/odr Komisja Europejska.
